With the increased usage of Ring doorbells, Alexas, and Google devices in the home, it changes the dynamic when buyers look at houses. These devices are always listening and/or watching. And I can assure that many sellers are eavesdropping – often illegally. In Texas, it’s legal to capture and view video footage of someone without their knowledge or consent. However, it’s not legal to record or listen to audio. Regardless, I tell my clients that they should expect the seller is listening to our conversation whenever we tour a home – so don’t say things like “This is the one. We’ll pay anything to get it!” While that example is pretty blatant, you really need to refrain from saying anything that might tip your hand in the negotiation process.
